* Buyer or consumer is any natural person who registers his personal data by electronic means through an order and / or submits a request for the service offered on the website, and whose order and / or request, the Seller will accept in the same way. The buyer or consumer is hereinafter referred to as the “User”.

A visitor to the site is any person who accesses the website through electronic means of communication and freely registers the offer of products and services without registration (hereinafter: “Visitor”). SVOD Master as a service provider or seller, i.e. trader works in accordance with the positive regulations of the Republic of North Macedonia. These general terms and conditions / Pre-contractual notification are compiled in accordance with the Law on Consumer Protection, the Law on Personal Data Protection, the Law on Electronic Commerce, the Law on Obligations and other applicable regulations in the Republic of North Macedonia.

By using the website www.gley.mk and agreeing on the service, it is considered that the Visitor of the site and / or the User is familiar with these Terms of Use / Pre-agreement notification, as well as the Rules for protection of privacy and cookies and accepts them.

The service is primarily intended for the territory of the Republic of North Macedonia, but it can be used in several geographical locations (hereinafter “Territory”). The content that may be available for review will depend on the geographical location and will change from time to time as agreed with the suppliers.

The user has the right to use the service of a limited number of devices, which number will be specified in the Agreement. SVOD Master can implement rules for the frequency of changes to the registered, approved devices by the User. Information on such rules will be provided to the User.
The service may contain materials that are considered inappropriate for minors and that other persons may find disturbing. Each content has a special age mark below to point out which content should not be accessed by children without the engagement, supervision and consent of parents or guardians. This content can be accessed through a Password or PIN code, and parents, guardians or other adults are solely responsible for using these child protection methods.
The quality of content display may vary from device to device and may be influenced by a variety of factors, such as the user’s location, the Internet (broadband available over the Internet) and / or the speed of the user’s Internet connection. Depending on the type of device, adequate picture quality is provided. The availability of HD video depends on the Internet services and the capabilities of the user’s devices. The user is responsible for all costs of Internet access. For information on possible costs for using the Internet data, the User can contact his Internet service provider.

The User may use the Service only for his personal use and in accordance with these Terms of Use, but may not: use the Service for commercial or public purposes; to use the Service for any illegal or inappropriate purposes; to copy / reproduce, borrow, sell, broadcast or otherwise distribute, edit or otherwise transmits or adapts the content of the Service; bypass, modify, remove, modify or in any other way manipulate any security, encryption or other technology or software that is part of the Service; otherwise use the Service, infringing copyright, other rights or the Terms of Use.

SVOD Master does not submit its own devices and does not take any responsibility for the performance of the approved devices or for their constant compatibility with the Service and its updating.

To use the Service, the User must have the necessary and approved systems, connection and equipment. The specification of current system requirements is available on the website. However, fulfillment of these system requirements does not guarantee that the user will be able to use the service indefinitely and for reasons beyond the control of SVOD Master. The use of the service may require the user to install third-party software. SVOD Master will provide information on the Website about which third-party software may be used, but SVOD Master is not responsible for the other person’s software and its update.

The service requires the user to have access to the required internet connection. The user is responsible for all costs associated with such connection, including data traffic costs, regardless of where the service is used. The specification for requesting the minimum download speed required to use the service is available on the website.

In order to use the services of the website, the user needs to ensure that his receiving device is functioning properly, that he is connected to the Internet, that the valid applications are installed on it and that he has appropriate computer software, depending on the type and model of the receiving device. The service is only available while the receiving device is connected to the Internet, regardless of the type of connection, which, among others, may include: mobile and fixed network infrastructure, home installation, wireless connection, hotspot, etc. The user is aware of the fact and accepts that the use of the service requires high quality Internet access and that, depending on the quality of the Internet connection, the Service may not always be available under equal conditions and with equal quality.

The agreement between the user and SVOD Master is concluded at the moment when SVOD Master, as a seller, accepts and submits to the User a confirmation of acceptance of the order for the Service. Namely, after ordering the service, the User will send a confirmation for Subscription / Agreement to the e-mail given by the User during the registration, which will contain a confirmation that the payment card account is debited as well as information about the client (username and e-mail ).

SVOD Master reserves the right to refuse to enter into a contract or to immediately terminate the contract with the User if the User has previously violated the General Terms and Conditions. Only individuals over the age of 18 who live in the Territory provided above can enter into an agreement with SVOD Master for the provision of the service. Minors can use the Service only under the supervision of an adult.

IP address data may vary from time to time, and therefore SVOD Master cannot be held liable if the user is temporarily unable to access certain content for such reasons. When registering and using the service, users are required to provide complete, accurate and precise information.

When registering, the User will be required to provide information on the method of payment. Obvious errors in the entered data will be checked and the User will be notified. Nevertheless, the User is obliged to review and confirm the accuracy of his data submitted during the registration procedure.

After registration, the user will be asked for all or some of the following information: name, surname, e-mail, password, credit / debit card number, CVV / CCV code, credit / debit card expiration date and name of the owner card, details related to the chosen method of payment, such as details of the payer’s account, voucher code or any other information that may be required to complete the registration (hereinafter: “Login Information”).

User login information is personal and may not be used by third parties. The user will save the login information to protect it from unauthorized access. The user is responsible for any use of the Service through his user account.

By sharing the service password or allowing others to access their own account, the account holder acknowledges that it assumes responsibility for members of the household or other persons who have access to its service account to comply with the terms set forth in the General Terms and Privacy Policy and is responsible for their conduct.

To use the Service, the user must register a user account on the website www.gley.mk and have access to the equipment, system and connections and enable payment of a subscription in accordance with the General Terms and Conditions. If the User does not cancel the subscription before the payment date, he authorizes SVOD Master to charge the subscription for the next cycle.

GLEY is a service that is charged in the form of a renewal subscription.

Renewal subscription is a type of subscription that the User can activate with a credit / debit card and which is automatically renewed every month with the possibility of canceling the Service at any time. If the User wants to cancel the renewal subscription, it must be canceled at the appropriate place in the user account.
By canceling, the User cancels the Service to which he has previously subscribed but is still active until the expiration date of the Service.

Also, SVOD Master is not obliged to return the money paid for the renewal subscription after the cancellation of the Service, ie for the month in which the Service is canceled because it is active until the expiration of the same month.

SVOD Master reserves the right to allow users a free trial for new users and some former users to try the service. SVOD Master reserves the right to determine the duration of the trial period at their own discretion.
If SVOD Master offers a Trial Period, the Eligible Users are entitled to a Trial Period. The entitlement to the Probationary period may be verified by the SVOD Master based on data received from the User, including, without limitation, e-mail, method of payment, and / or ID devices listed in the user account, to prevent misuse. on the Trial Period. If SVOD Master is suspected of abusing the Probationary Period, or its terms, it may immediately take action to warn of such abuses, including termination of the Agreement. The user is informed about the expiration of the trial period by e-mail on the day of activation of the subscriber account. If the User does not terminate the Agreement before the expiration date of the trial period, then the Agreement will be automatically transformed into a regular monthly subscription.

If the User is not entitled to a trial period, the first payment of the subscription will be made on the day when the User concludes a Contract, and subsequent subscriptions to the Service for the upcoming month will be made in advance on the same day in each month corresponding to the day of the Service Agreement. If such a day does not exist in that month, the last day of that month is the payment date.

If the Client has not provided sufficient funds on the due date, SVOD Master will provide notice of “failed payment” to the client’s email at registration and SVD Master will again attempt to charge a fee – no more than 5 (five) times – with using the recovery method chosen by the user. If the payment is not made on time, SVOD Master Skopje has the right to immediately terminate or restrict the User’s access to the Service or to terminate the contract immediately.

Payment is made via: Credit or debit cards MasterCard® and Visa. The data you enter when paying from your payment card is not stored or transferred through our servers. Transactions are processed through the technical solution of Komercijalna Banka AD Skopje, in cooperation with International Card System AD CaSys, which is certified by VISA and MasterCard for processing transactions that will allow payment services with real-time payment cards through the website.

At the moment you make the payment and enter the data, they are processed through the security protocol of the bank and for us the data from your payment card are not visible, the only information about your transaction that is visible to us is your Name and Surname from the payment card, the last 4 card numbers and the amount on which the transaction was made, while all others are encrypted.

If the User uses a Trial or Promotional Period, the subscriber period starts on the first day after the end of the Trial or Promotional Period and is automatically extended for one month until the User or SVOD Master terminates the Agreement.

If the User wishes to terminate the Agreement, SVOD Master must be notified by email, or, if SVOD Master provides such an alternative, via the link website. In case the User initiates termination of the Agreement, SVOD Master will send the Customer a confirmation via e-mail at the end of the subscription period. If SVOD Master wants to terminate the Agreement, then he is obliged to notify the User by e-mail. The Agreement will be terminated at the end of the current period for which the Agreement is concluded.

Under the conditions provided herein, SVOD Master has the right to terminate the Contract and at the same time to immediately make the Service inaccessible to the User in any of the following cases:
• The customer is late with the payment for at least three days;
• There are reasonable grounds for assuming that the User is insolvent,
• The user abused the Trial Period, Promotional Period or its terms
• There is unauthorized use of the Service or there are reasonable grounds to assume that such unauthorized use occurs,
• The User has attempted to use the Trial Period more than once (1) during a related period of twelve (12) months, or The User otherwise committed a material breach of the Agreement, or repeated the breach of the Agreement.

Content change is significant when the amount of content covered by the Service is drastically reduced or the overall content orientation is significantly changed. The expiration or termination of the license for certain programs or series, or the decision not to produce or to include further seasons of certain series is not considered a significant change. A significant change is only that change which will result in a significant reduction of all titles included in the Service. Significant reduction means a reduction of 50% or more of all titles in relation to all content covered by the Service.

The User will be notified of changes related to the amount of the fee or the content via e-mail specified by the User no later than thirty (30) days before such changes take effect. Together with such amendment, the User has the right to terminate the Agreement with effect on the day when the amendment enters into force. SVOD Master is obliged to inform the User in his notification about his / her right to terminate the Contract.

If the User does not terminate the Agreement before such change enters into force, the User is considered to accept the change. In case of early termination, where the User has made the payment that refers to the period after the expiration, SVOD Master will return the remaining amount within thirty (30) days from the expiration of the Agreement.

SVOD Master will not be responsible for reducing the quality of the service provided and interruptions, delays or other errors if they occurred for objective reasons that cannot be predicted, avoided or eliminated (force majeure).
Customers are not entitled to any compensation in case of interference, interruption and other errors of the Service, which are the result of regular maintenance of the system. The system requires regular maintenance for up to 5 hours per month, which is performed from 6:00 to 8:00 in the morning.

In the event of a sudden technical problem that could significantly affect the delivery of the service, immediate system maintenance is possible. If the emergency maintenance lasts continuously for more than 24 hours, the users who request it have the right to a proportional reduction of the subscription, unless the emergency maintenance is caused by circumstances beyond the control of GLEY.mk (force majeure). Urgent maintenance: can be performed at any time if there is an urgent technical problem that may have consequences for the delivery of the Services. During the current arrangements, the Service may be unavailable. In case of such interruptions, delays and other errors for which SVOD Master is responsible and for which the Service is unusable for an uninterrupted period longer than 24 hours, the users who request it have the right to a proportional reduction of the subscription.

All such content is protected by copyright and related rights. Any change, rental, sale or distribution of content is not permitted without the prior written consent of SVOD Master. If the user believes that copyright or related rights have been infringed, they are obliged to notify SVOD Master about it as soon as possible. If SVOD Master establishes that the user uses or distributes the content without authorization, SVOD Master has the right to temporarily and without notice prohibit access to that content to the individual user, and to initiate legal proceedings in order to obtain compensation.

The User and SVOD Master are obliged to first try to resolve any dispute arising from this Agreement amicably. If the parties cannot agree, the dispute will be resolved before the competent court in the Republic North Macedonia. The Law of the Republic Nort Macedonia shall apply to the Agreement, unless otherwise provided. Consumers have the right to certain consumer protection and application of other binding provisions based on the law of the Republic North Macedonia.

GLEY.mk can send notifications to the User via e-mail or by publishing on the website. The user is obliged to update their contact information if they change during the use of the Service. GLEY.mk will be deemed to have fulfilled its obligation to provide notifications by sending notifications to the last given e-mail address of the User, regardless of whether the User still uses that address, or it is no longer used.
